Maintaining Proper Tyre Thickness can Reduce Accidents

December 2nd, 2009

It is important to check tyres regularly, especially in case of cars that are driven a lot, as failure to do so can lead to accidents. However, drivers employed by most companies often fail to check the tyres on a regular basis.

A recent study by TyreSafe, a non-profit organisation working for better tyre safety, shows that one fourth of the professional drivers have never checked tyre treads in their lives. The study further shows that more than 40% have not checked the status of their car tyres in more than half a year. The current UK law makes it mandatory that the tread on the tyres should be a minimum of 1.6mm across the central three quarter of the tread throughout the circumference of the tyre. However, this measurement is not followed most of the times.

According to Stuart Jackson, the Chairman of TyreSafe, while both companies and drivers are responsible for such lapses, it is the responsibility of the companies to ensure that the drivers undertake the necessary safety procedures. Since company cars are driven much more than private cars, their tyres are more likely to wear out fast.

TyreSafe has come up with an easy way to check thickness of tyres. This checking can be done by using a 20p coin. The coin has to be inserted in the main grooves of the tyre. If the outer rim of the coin is visible, it would mean that the tyre has lost its thickness and needs to be checked or replaced. According to Mr Jackson, this test is easy and can be performed by anyone. It has to be done only once in a month and it will ensure tyre safety and save many lives.

Make sure that your company is not in the dark when it comes to new health and safety regulations, keep up-to-date by making sure you take advantage of the IOSH training services operated by reputable companies such as Workplace Law.

Paralegal College - A Window of Opportunity

September 25th, 2009

Within the paralegal profession, there are countless organizations that contribute assistance and assets to their paralegal members but truth be told the paralegal field is really governed by a few, but extremely influential groups. These top few professional organizations which can honestly claim over 30,000 paralegals as members; include NFPA, NALA and AAPI. The National Federation of Paralegal Associations and the National Association of Legal Assistants have competed for decades to influence the language of the profession while the American Alliance of Paralegals (established in 2003) is focused on creating and implementing the best paralegal training possible.

Vital aspects to remember when breaking down a paralegal program:

1. Paralegal degree courses must teach hands-on applicable job skills in addition to bottom-line legal theory. The curriculum should also emphasize legal writing, torts, legal contracts and research and legal ethics. A paralegal college should advance a students’ discriminating thinking capacity along with communication, organizational skills and an aptitude to correctly handle ethical issues. An opportunity to gain real-world experience before graduation through internships or clinical experience is also important.

2. You’ve done some research and narrowed your “possibilities” down to a few paralegal schools. Now you need to ask yourself a few questions. Are the teachers any good? Is the curriculum applicable in today’s legal arena? Good questions and here are a few answers. Look for the program director to have a law degree and a solid track record of experience working as an educator or trainer in the legal field. Find out if the instructors are paralegals with real-world work experience who really know their stuff and with impeccable educational credentials.

3. A broadening number of paralegal schools and universities have made their entire paralegal degree training programs available online. However, it’s recommended that before any wanna-be student signs up they find answers to a few important points. First, how will the material be delivered? Will all lectures be live interactive video or DVD tele-courses, or text-based with access via the web or a combination thereof? Also, because of the nature of the learning it takes much more self motivation and discipline to compete the work. Do you have what it takes to learn online?

Even if down the road your goal is to become a lawyer, starting your professional life in law as a paralegal is a wise initial step. Earning your paralegal degree will allow you to get a foothold into the legal field, which in turn will expose additional opportunities. And then, down the road you can make a more informed decision as to whether or not to pursue your law degree or to keep working as a paralegal. In any case, opportunities will be many.

High Heals Risky for Women’s Health, Say Experts

September 24th, 2009

A recently held Trades Union Congress (TUC) meeting saw the Society of Chiropodists and Podiatrists put forward a motion demanding the assessment of risks associated with wearing high heels at workplaces. The motion also urged all employers to impose an immediate ban on all policies that made the wearing of high-heeled shoes by women mandatory.

Lorraine Jones of the Society noted that many retail sector bosses force women workers to wear high heels as part of their dress code and urged them to allow women to choose their dresses. The motion said about two million days are lost per year as workers suffer from limb disorders and stay away from work. It revealed that joint and limb problems are often caused by the constant use of high heels and that the National Health Service (NHS) spends millions of pounds every year to treat foot disorders.

However, Lorraine Monk of the University and College Union (UCU) opposed the motion saying the media will portray it as an act of fashion policing, even though its intention is the welfare of women workers. She questioned why the motion only imposes regulations on women while leaving men free to do whatever they like.

She pointed out that the dress codes were always framed by men and narrated a case, which was successfully fought by her union, involving a mandate in a college that had banned all sleeveless and short-sleeved dresses for women lectures.

Monk said the issue of high heels was one that had women divided for and against it, and suggested that the union should rather take up the matter of all improper dresses at workplace. She also said that heels represented a much wider debate on gender roles and therefore should be left aside.

She called for a debate on the women

Fleet Safety Forum Leads Campaign against Tired Driving

August 5th, 2009

Brake, the road safety charity has taken up a campaign called Wake Up! that is calling upon employers to tactfully handle driver tiredness which has led to many road accidents.

The campaign is trying to get employers into revising the schedules of their drivers, so as to ensure that their health and safety are not risked due to exhaustion, especially when the economy is going through a bad phase and they are under pressure to work harder. Workplace Law Training run a highly regarded Certificate in Personnel Practice (CPP course) that could be just the ticket for implementing a performance review processes to boost team performance.

According to a research conducted by Brake, approximately 10% of the drivers accept having slept behind the wheel on one or more occasions, while around 50% of them accepted that they slept for less than five hours before driving. However, the data was different for drivers, who do not drive for pay. The statistics suggested only 5% admitted to having slept behind the wheel and only 35% of them sleep less than five hours normally.

Roz Cumning, Fleet Safety Forum manager at Brake explained that the problem of driver tiredness has resulted in several accidents and could financially harm a company in the long run. He also suggested that to tackle such a problem there should be a sound risk management system.

Brake has also introduced an information package for fleet managers and drivers to identify when a driver is tired and to prohibit him from driving further. The program includes urging employers to make the campaign a success.

Beating the recession with unpaid overtime

March 6th, 2009

The TUC has thrown some light on the effects the economic slowdown is having on the work hours of employees. It has been reported that in many industries people are working overtime without an extra pay in order to increase business efficiency.

Around a third of the workforce in industries like finance and public administration are putting in unpaid overtime. As compared to the statistics from autumn 2007, people in agriculture are putting in as many as 13 days extra without pay. Similarly workers in tool hire and garages are working 7 days and 5 days extra without pay respectively.

It has also been reported that the UK has roughly five million people working over seven hours unpaid overtime per week, as the fear accompanying the recession has hit hard both the employers and their employees.

Brendan Barber, TUC General Secretary says that the current situation has people willing to work extra hours without any demands. However the interesting fact is that although employees in many industries are working longer to finish the job faster, there are many other industries where the effect has been entirely opposite, with people not having sufficient work to fill even their regular hours.

Mr. Barber adds that though overcoming the recession is important and people are willingly putting in extra hours out of fear of losing their jobs, it is not a welcome practice and needs careful handling on part of the employers. A culture should not be created where the employees believe that staying back late in the office means they are less likely to be laid off.

Workers putting in extra hours could be at an increased risk of workplace accidents, Contact the experts at Workplace Law Training to find out about their range of first aid at work training courses which can assist companies in training staff to be aware of the proper health and safety procedures for all kinds of workplace situations.

How to Behave in Divorce Court

May 21st, 2008

Copyright 2006 The Divorce Center P.A.

If you or your spouse are unable to agree on the terms of your divorce, everything will be decided by a judge in a final court trial. You have a right to request a jury trial. Most people are familiar with jury trials - where a jury of citizens from your community will decide the issues.

But family law courts are overcrowded and overworked. While a jury trial is your right to request, asking for one will give the judge a negative impression of you before your case ever begins. In many states, including Florida, the “bench trial” is the trial of choice for a divorce case. A bench trial has no jury. The judge serves as the jury and also serves as the judge. The bench trial concentrates all the decision making power in one person, the judge. So in a typical divorce, the judge is the most important person in your life. So it is best to always “play to the judge” throughout your case.

The vast majority of judges are intelligent, compassionate, and concerned with doing the right thing. But judges are human and you must guide your behavior in, and out of court, by how you may appear to another person. From the start of your divorce to the final judgment (and possibly beyond) you must take “the high road.” This means you should act rational and with integrity. Don’t act up, or do anything the judge may use in a decision to punish you.

Always tell the truth and do what you promise to do. If your actions don’t match your words, a judge will pick up on that. Be the person everyone admires throughout your divorce and the judge will pick up on that as well. A judge will frequently give the benefit of the doubt to a person that appears to be rational and honest. Further, a judge that gives you the benefit of the doubt will go out of his or her way to do the right thing.

However, you must be aware that as human beings, judges can act unpredictably. You may get a certain ruling because the judge “woke up on the wrong side of the bed” that day and you looked like the bad-guy in court. Again, you will always come out best if you maintain a squeaky clean image. During your hearing, avoid appearances of instability. Even if you don’t speak during your trial, the judge is probably looking at and evaluating you.

Don’t:

• interrupt your attorney every 3 minutes
• glare at your spouse or the opposing attorney
• speak directly to the other party or attorney
• speak to the judge if you have an attorney - unless asked to
• furiously write notes in a compulsive-looking manner
• wear revealing or dirty clothing

The rules strictly prohibit any communication with the judge outside the presence of the other party. So do not attempt to speak to the judge in private. Letters to the judge are also prohibited. All communications with the judge must be conducted in the presence of the opposing party. And in practice, any communications must be done at a mutually arranged hearing in front of the judge. Finally, always be aware your actions and words are being measured and analyzed by a stranger. But in this case, the stranger is a judge and has power over your life and your divorce.
